Intertops.com Affiliate Partner Terms & Conditions
 

  1. Intertops.com is in the business of online sportsbetting, casino gaming, and poker all for fun and for real money. The Affiliate program grants the non-exclusive right to third parties to market the services of Intertops.com and to attract new customers to Intertops.com. The Affiliate will share in the revenues generated by those customers referred by the Affiliate in accordance with the terms and conditions established herein as well as the existing rules, procedures and policies of Intertops.com.

  2. Intertops.com will register Affiliate referred customers and will track their play. Intertops.com reserves the right to refuse customers or to close the accounts of previously accepted customers at its own discretion.

  3. Intertops.com will provide timely, statistical reports to Affiliates detailing the tracking and monies earned by the Affiliate's referred customers. Intertops.com will also provide the Affiliate with online remote access to the Affiliate's referral reports on a best efforts basis.

  4. The Affiliate and Intertops.com enter into a non-exclusive referral arrangement as independent contractors. The Affiliate and his/her website are not employees, partners, sales agents, franchisees, joint venture partners or in any other way interested or related parties. Intertops.com has no responsibility or liability in regard to the Affiliate's website or the Affiliate's business, nor does the Affiliate have any interest whatsoever in the business of Intertops.com.

  5. The rights of the Affiliate are limited to the Affiliate's permission to post the banner(s) and content provided by Intertops.com, on the Affiliate's website and to link the banner(s) and content to the URL provided by Intertops.com. The Affiliate may not in any other manner represent or market the services of Intertops.com, nor may he/she use the logos and trademarks of Intertops.com or claim to be in any way in business partnership with Intertops.com other than as a linking Affiliate, without the expressed written consent of Intertops.com. The Affiliate agrees to indemnify and hold Intertops.com their directors, officers, employees and representatives harmless from and against any and all liabilities, losses, damages and costs, including reasonable attorney's fees, resulting from, arising out of, or in any way connected with (a) any breach by you of any warranty, representation, or agreement contained in this Agreement, (b) the performance of your duties and obligations under this Agreement, (c) your negligence or (d) any injury caused directly or indirectly by your negligent or intentional acts or omissions, or the unauthorized use of our banners and link or this referral program.

  6. The Affiliate will earn referral commissions based on the following calculation to determine the net house profit.

    Profit SB*20% + Profit CS*20% + Profit PK*20% - (Aff. Bonus+Bonus SB CS)*20% - Bonus PK*20%

    Profit SB = Staked - Refunded - Won
    Profit CS = ChipsPurchased - ChipsCashed In - Royalties
    Profit PK = Poker Rake

    The payout percentage is determined based on the total revenue generated by the Affiliate. The more revenue generated by the Affiliate, the higher the potential earnings will be.

  7. Intertops.com will remunerate its Affiliate partners based on the following revenue schedule:

    $1-20,000 (20%)
    $20,001-30,000 (25%)
    $30,001-40,000 (30%)
    $40,001+ (35%)

    The revenue schedule is established by Intertops.com from time to time and is subject to change without notice.

  8. Intertops.com will credit the Affiliate referral commissions on a weekly basis, earned by him/her in the previous week, by the Wednesday of each week. All payments will be due and paid into the Affiliate Partners Intertops.com account every 4 weeks. If the account is in a negative position (e.g. because customer winnings have exceeded customer losses) the negative position will be carried over until the following week. The Affiliate will only receive a payout when there is a positive balance.

    The Affiliate may himself/herself be a playing customer at Intertops.com, however under no circumstances may the Affiliate either directly or indirectly be paid referral fees for his/her own play.

  9. The Agreement between the parties shall commence when the Affiliate links an Intertops.com banner or content provided by Intertops.com, to the Intertops.com website.

    Either party may cancel the present agreement in writing by declaring its desire to do so.

    In the event of termination;

    • The Affiliate must remove any and all Intertops.com banners, content and links from the Affiliate's website.
    • All rights provided to the Affiliate in virtue of the present agreement shall terminate immediately.
    • The Affiliate will only be entitled to those unpaid referral fees, if any, earned by the Affiliate on or prior to the date of termination. The Affiliate will not be entitled to referral fees with respect to play occurring after the date of termination.
    • Intertops.com reserves the right to withhold any payment due to the Affiliate in order to ensure that the correct amount is owed and paid.

  10. Obligations under this Agreement do not constitute personal obligations of Intertops.com or its directors, employees or shareholders. Any liability arising under this Agreement shall be satisfied solely from the referral fee generated and is limited to direct damages.

  11. This Agreement will be governed by the laws of Antigua & Barbuda, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in Antigua and the Affiliate irrevocably consents to the jurisdiction of its courts.

  12. The current agreement is non-transferable.

  13. Intertops.com is strongly opposed to the use of spyware, adware (Gator etc.) or any other method of unauthorized browser acquisition. Intertops.com reserves the right to terminate affiliate accounts if they are found to be using any of the above methods to redirect traffic to our site. Once discovered, Intertops.com will ask the affiliate to desist the practice via an email. If no action is taken on the part of the affiliate within 7 days, the account will be terminated.

  14. The Affiliate expressly agrees to the terms and conditions of this Agreement by downloading the Intertops.com banner(s) or creating a link from his/her site to the Intertops.com website.


    "Poker Rake" = Sum total of all players' contributions to all rakes the players were involved in whilst playing in the Poker Room, less any bonus or promotional amounts given to the players, processing charges, charge backs, or any uncollectable revenue attributable to the player.

    Player's contribution to the rake = Actual amount of each rake to which the player has contributed divided by the total number of players at the table at the start of the hand
